I am in receipt of letter from Farm-
ers Mutual Exchange, Mr. G. P. Mc-
Craine, Manager, at Adel, Georgia,
-with regard to damages to seed pea-
nuts treated with Spergon W. P.
Spergon W. P. was not registered as
a seed treatment and was not approved
as a seed treatment, therefore, the sale
of it as a seed treatment was a direct
violation of the Insecticide Law.
Because the Commissioner of Agri-
culture has no authority under the law
to persue these claims, as is the case
with the Fertilizer Law, it will be nec-
essary for farmers, shellers and dealers
to bring their own claims in court if
they desire to recover.
After a conference between the Gov-
ernor, the Attorney General, Mr. H. L,
Wingate, President of the Georgia
Farm Bureau Federation, and myself,
the Attorney General took under ad-
visement the question of whether or
not the Law Deparment could represent
farmers, shellers and dealers in these
cases.
_ The Attorney General tells me that
_he cannot bring original action in these
cases but that he and his assistants will
be glad to assist in any way they can if
local attorneys are employed to bring
action,
From this it is clear that unless the
farmers, dealers or shellers institute
some proceeding on their own initiative
* that nothing will be done about this.

has depended on the Dallas Office for
this grading and inspection service and

Memorandum of Agreement between
the. U. S. Department of Agriculture
and the Georgia Department to make
the Federal shipping point inspection
service on fruits and vegetables, autho-

available to the people of Georgia than
would be feasible without the aid and

cept in the case of peaches which under

satisfactory, as there is no more dump- _
ing of green or inferior Georgia peach-
es on the markets. Our peaches are de-
manding the market price.
Likewise the U. S. Department of
Agriculture has, for a number of years,
| provided Market News Service both for
peaches and watermelons during the
marketing season with headquarters at
Macon and Cordele respectively. During
the eurrent vear, the State Department
has participated in this service, bearing
50 percent of the total expenses, which _
provides current Market News Service
for all the peach and watermelon grow-
ers of Georgia.
The Department likewise has pro-
vided other grading and inspection ser-
vice which can be put into effect when
needed under a Memorandum of Agree-
ment with the U. 8. Department of Ag-
riculture, effective June 1, 1946. This
Memorandum provides for Inspection
Service for processed fruits and vegeta-
bles and is available to distributors and
processors. If and when the processors
of Georgia need this service. it can be
provided,
