3. The sheller or dealer who proper-
ly applied the seed treatment to the
seed has the right to recover from the
manufacturer of the treatment any
damages which the sheller or dealer
is liable to the farmer on account of
the treatment if it is deleterious or not
of sufficient strength to properly pro-
tect the seed. In other words, if pea-
nuts failed to come up because of the
us of a treatment which failed to pro-
tect the seed, then the farmer has a
claim both against the sheller ae
manufacturer and the sheller has
claim for his own protection etek

REMEDIES
There are several possible legal courses
of action which the farmer may pursue
in order to recover for the legal damages
suffered as a result of planting damaged
seed. Ina great many cases, however, if
the individual farmer is forced to employ
an Attorney and bring an individual
suit, the cost involved would be prohibi-
tive and for that reason we have tried to
find a possible course of action that
would permit the farmers collectively to
bring an action to recover for all of them.
On account of legal questions involv-
ing jurisdiction, the combining of claims,
or joinder of parties, ete., and other legal
difficulties, these lawyers spent a great
deal of time discussing possible. pro-
cedures to ayoid multiplicity of law suits
and also to avoid the necessity of each
farmer having to enforce his individual
claim.
Tt was the consensus of opinion among
the lawyers present at this conference
that the farmer has a right of action
- against the sheller or dealer because of
the defectiveness of the peanuts and that
the farmer is not compelled to bring any
action against the United States Rubber -
Company in order to enforce his rights.

If the farmers undertake to recover
against the shellers and dealers who ap
plied the seed treatment and sold the
seed peanuts, each farmers case would
have to stand on its own merit, but the
farmers in the neighborhodd could get
together and employ an Attorney eol-
lectively to handle all their claims. This
in the long run, is what they would have
to do any way because there is no pro-
vision of law under which the Commis:

to recover for the farmers and for tha

employ counsel and pursue these claims
The Commissioner of Agriculture will, |
of course, cooperate and be of every pos- |
sible assistance in protecting the farmers
and will also do what he can to help the
shellers and dealers in adjusting thei
claims against any manufacturer whose
product has caused the damage.
As soon as the facts are all in, I wil
prepare the official report of the Com-
missioner of Agriculture, covering the
investigation in this matter. As soon as
_the facts are all in and combined, copy |
of that report will be furnished to an;
Attorneys who may be engaged by any
parties of either side of any litigation
that might arise out-of this matter.
