It was further developed that United
States Rubber Company did not register
_Spergon W.-P. as a seed protectant
but they did sell it under a label as :
protectant for seed peanuts.
Here we have hundreds of farmers
scattered over a wide section of the
State. Men with years of experience in
growing peanuts; some of them planted >
earlysome planted late. Some had
excessive rains and some did not.

Yet, in spite of all these many factors,
the one fact common to them all was
that seed treated with Spergon W. Pk
did not come up but where other treat-_
meuts were used and where no treat-

were obtained. This was true to the ex-
tent that different seed planted in the
: same field, at the same time, failed to
come up when treated with Spergon
W. P., but did come up where Sper-
gon W. P. was not used. .
With all this evidence in hand, I ask-
ed the representatives of United States
Rubber Company what they were going
to doabout it. Mr. Plitt Sadtler, At-
torney for the United States Rubber
Company, New York City, stated in ef-
fect that the company had no liability in
the matter meaning, of course, that the
company was not going to do anything
about it. ~
Because of these facts T have cancelled
all registrations for all products of
United States Rubber Company reg-
istered in this Department as I believe
the only way to adequately protect the
farmers of the State against non-resi-
dents who refuse to stand behind the
products they sell is to cancel their reg-
istration and stop the sale of such prod-
ucts. :

mittee with attorneys, in the office of
the Commissioner of Agriculture, -Tues= a
, day; May 17, 1949 and try to get definite
action started and make every effort
possible to recoup the losses sustained,
The Georgia Seed Law does not give
the Commissioner of Agriculture au-
thority to collect losses for farmers as
does the Fertilizer Law. Under the_
Fertilizer Law the Commissioner.of Ag-
riculture is authorized and directed to-
eolleet penalties to which the farmers
are entitled for fertilizer deficiencies. _
The Seed Law simply provides that
the Commissioner of Agriculture ean
make investigation and make report of
his findings. And, the Commissioner cs
report can be used as evidence in the
trial of claims for damages gr owing out
of the sale of seed that are sold in viola-
tion of the Seed Laws.
This is the reason it is necessary to
get this committee, representing the dif
ferent parties interested, together in
order to combine our efforts and try to
force the manufacturers to back up this
product which they sold in Georgia.
Spergon W. P. is a pink poe
and gives peanuts treated with it a very
bright color. It does not gum up the
peanuts as Ceresan and other seed
treatments do, but leaves them in a_
mechanical condition to pass easily
through the planter. This has been one
of the talking points of the salesmen for
its use.
After the meeting May 17th, we will i
probably need full information from the
farmers who planted peanut seed treat-
ed with this pink powder, and who did
not get up a satisfactory stand.
